1) Acceptance of These Terms

By using our website, calling or texting us, submitting a form, or scheduling service, you agree to these Terms. If you do not agree, do not use the site or our services.

2) Privacy & Data Use (Aligned With Our Privacy Policy)

Your privacy is governed by our Privacy Policy. We do not sell or share personal information. We collect only information you voluntarily provide (calls, texts, emails, forms) to respond, schedule, and deliver services. We may forward your inquiry to our owner-operators/technicians solely to fulfill your request (e.g., estimate, dispatch, updates). If any conflict arises between these Terms and the Privacy Policy regarding data practices, the Privacy Policy controls.

3) Brand Site & Lead Forwarding

SureDrySoCal.com is a brand site. Leads submitted here are forwarded to the local owner-operators who perform the work. Forwarding occurs only to fulfill your request (estimate, inspection, scheduling, or service).

4) Service Area & Nature of Services

We provide water damage restoration, mold remediation, fire/smoke cleanup, and related services in Southern California (residential and commercial). 24/7 emergency response is offered as resources permit.

5) Estimates, Scope & Changes

• Free visual estimates may be offered; they reflect visible conditions at the time and are not guarantees.
• Hidden conditions (inside walls/subfloors, asbestos/lead, microbial spread) may change scope and price.
• Changes will be documented via change orders and require your approval.
• Insurance requirements and building codes may affect methods and timelines.

6) Scheduling, Access & Site Safety

You agree to provide safe access to the property and to secure pets, valuables, and breakables. We may need access to water, power, and disposal areas. If we arrive and cannot access the site, a trip/no-show fee may apply.

7) Insurance Coordination (We Are Not Your Agent)

At your request, we can assist with documentation and coordination and communicate with your insurer. We are not the insurance company, do not adjust claims, and cannot guarantee coverage, approvals, or payment timing. You remain responsible for deductibles, exclusions, and any carrier shortfalls.

8) Customer Responsibilities

Promptly report new leaks or hazards; follow equipment and safety instructions (e.g., keep drying equipment powered). Obtain permits/approvals where required unless our contract states we will do so.

9) Payment Terms

Unless otherwise stated in your work authorization, payment is due upon substantial completion or in agreed progress draws. Late balances may incur late fees and reasonable collection costs. For insurance jobs, you remain responsible for any amounts not paid by the carrier.

10) Contents & Limitations

Unless expressly included in your scope, we do not inventory, pack-out, or store contents. We are not responsible for normal dust/odors during drying or for pre-existing conditions. Please remove or secure fragile and high-value items unless our contract states otherwise.

11) Photos, Videos & Testimonials (Aligned With Privacy Policy)

With your permission, we may document job progress (photos/videos) for work records, insurance documentation, and quality control. Any marketing use (e.g., before/after photos) occurs only with your consent, consistent with the Privacy Policy.

12) SMS/Texting & Calls (Aligned With Privacy Policy)

By contacting us, you agree we may respond by phone or SMS about your request (estimates, scheduling, updates). Message/data rates may apply. You can opt out of SMS at any time by replying STOP. We do not sell phone numbers and use them only to provide or market SureDry services as described in the Privacy Policy.

13) Website Use & Intellectual Property

Site content (text, graphics, logos, photos) is owned by SureDry or licensed to us. You may not copy, modify, or distribute content without permission. Do not misuse the site (e.g., security breaches, scraping, spam, illegal activity).

14) Third-Party Links & Tools

The site may link to third-party websites or tools (e.g., maps, chat, scheduling). We are not responsible for their content, policies, or availability. Use them at your discretion.

15) Warranties & Disclaimers

We provide services with reasonable care and skill consistent with industry standards and your signed work authorization. EXCEPT AS EXPRESSLY STATED IN WRITING, WE DISCLAIM ALL OTHER WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Weather, structural conditions, and hidden moisture can affect outcomes and timelines.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SITE OR SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SPECIFIC WORK GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS), EVEN IF ADVISED OF THE POSSIBILITY.

17) Indemnification

You agree to indemnify and hold SureDry, its owner-operators, and technicians harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from: (a) your misuse of the site or services; (b) your breach of these Terms; or (c) property conditions not caused by our negligence.

We are not responsible for delays or failures due to events beyond our reasonable control (e.g., severe weather, utility outages, supply chain issues, strikes, epidemics, government actions).
